Arizona Senate Passes Sen. Wendy Rogers SB1426 Strengthening Private Property Rights Against Unlawful Occupants

The Arizona Senate has unanimously passed SB1426, legislation sponsored by Senator Wendy Rogers to strengthen the rights of property owners facing unlawful occupants.

SB1426 clarifies Arizona law regarding forcible entry and detainer actions, giving property owners clearer legal tools to remove individuals who unlawfully occupy residential property. The legislation aims to ensure that homeowners and landlords can quickly regain control of their property when someone refuses to leave without legal authority.  

Across the country, property owners have faced growing concerns about individuals occupying homes without permission while exploiting gaps in eviction laws. SB1426 reinforces the principle that private property rights must be protected, while providing law enforcement and courts clearer procedures to address unlawful occupancy.

Senator Rogers sponsored the legislation as part of a broader effort to protect Arizona homeowners and ensure the law supports property owners rather than those who violate their rights.

On February 26, the Arizona Senate passed SB1426 unanimously, demonstrating bipartisan agreement on the need to protect Arizonans from unlawful occupants. The bill has now been transmitted to the Arizona House of Representatives for further consideration.
