Arizona Senate Passes Sen. Wendy Rogers Legislation Blocking Public Benefits for Illegal Immigration and Pending Asylum Seekers

Arizona lawmakers have passed Sen. Wendy Rogers’ SB 1152, a major immigration accountability measure that ensures state and local public benefits are reserved for those legally entitled to receive them.

SB 1152 makes clear that a person with a pending asylum application before an immigration court is not eligible to receive state or local public benefits until asylum is formally granted by an immigration judge. That means taxpayer-funded grants, welfare programs, housing assistance, unemployment benefits, and similar aid will no longer be available to individuals whose immigration status has not yet been approved.

Arizona law already requires agencies to verify immigration status before issuing benefits. SB 1152 strengthens that framework by closing a loophole that allowed individuals with pending asylum claims to access state-funded assistance before their cases were decided. This bill reinforces the principle that public benefits funded by Arizona taxpayers must be reserved for lawful residents and citizens.

Senator Wendy Rogers sponsored SB 1152 as part of a broader effort to ensure Arizona’s public assistance programs are not exploited and that taxpayer resources remain focused on serving Arizona citizens and legal residents.

Complementing this effort, lawmakers also advanced SB 1338, another Rogers-sponsored measure that strengthens Arizona’s verification requirements for public benefits and reinforces existing eligibility rules. The bill clarifies documentation requirements proving lawful presence in the United States and strengthens enforcement mechanisms to ensure government agencies properly verify eligibility before issuing taxpayer-funded benefits.  

SB 1338 also establishes penalties for state or local employees who knowingly fail to report violations of federal immigration law and allows Arizona residents to bring legal action if agencies fail to properly enforce the law.  

Together, SB 1152 and SB 1338 strengthen Arizona’s existing voter-approved safeguards governing public benefits. The legislation also requires a three-fourths vote of both chambers under Proposition 105 to amend voter-approved statutes, underscoring the seriousness of changes affecting taxpayer-funded programs.

With these measures advancing, lawmakers have sent a clear message: Arizona will not subsidize illegal immigration through state-funded programs.

SB 1152 passed the Arizona Senate on February 27 and has been transmitted to the House for consideration. SB 1338 also passed the Senate and was transmitted to the House on February 27, continuing its progress through the legislative process.  

SB 1152 and SB 1338 protect limited public resources and prioritize the needs of Arizonans. At a time when border security remains a national crisis, these measures ensure Arizona’s safety net is not stretched beyond its intended purpose.
